In any case of real estate transfer for consideration, a tax shall be levied on its value, and the purchaser shall be liable for its payment. Prior to the transfer contract being drawn up, the vendor and the purchaser shall submit a joint real estate transfer tax (FMA) return.

The tax office in the spatial jurisdiction of which the property is situated shall be the competent tax office for filing the return. With regard to returns filed digitally through the electronic application myProperty, the competent authority is the tax office for the purchaser’s income.

In areas where the statutory valuation system is applied, during the filing of the real estate transfer tax return, the taxpayer must indicate the statutory value of the property being transferred, on the basis of which they shall pay the corresponding tax as a lump sum. Where the consideration exceeds the statutory value, the tax shall be calculated on the basis of the consideration. (In areas not subject to the statutory valuation system, the market value of the property shall be declared and the tax thereon shall be paid as a lump sum. Moreover, the property shall undergo an estimate of the property's value on the basis of comparative data and, should it be accepted by the taxpayer and be greater than the value declared, the additional value shall be paid in two (2) instalments).
